What is an Affidavit of Single Status?

An Affidavit of Single Status is a legal document that confirms an individual’s unmarried status. This document is often required for various official and legal purposes, including international marriage, visa applications, and property transactions. It serves as a sworn statement that a person is free to marry and has no legal marital obligations that would prevent such a union.

Purpose of an Affidavit of Single Status

International Marriage Requirements

Many countries require a foreign national to provide proof that they are legally single before they can enter into marriage. This affidavit ensures that the individual is not already legally bound to another person in their home country.

Visa and Immigration Applications

Some visa applications necessitate proof of single status, particularly for spousal or fiancé visas. Immigration authorities may request this document to verify eligibility for a marriage-based visa.

Legal and Business Transactions

In certain jurisdictions, an Affidavit of Single Status is needed for legal and business dealings, such as property purchases, inheritance claims, and financial agreements.

How to Obtain an Affidavit of Single Status

Where to Request the Document

The affidavit can typically be obtained from a notary public, county clerk’s office, or other designated government agency, depending on the jurisdiction. Some embassies and consulates also provide this service for their nationals residing abroad.

Information Required

When applying for an Affidavit of Single Status, the following information is usually required:

  • Full legal name
  • Date and place of birth
  • Current address
  • A sworn statement declaring that the individual has never been married or is legally divorced/widowed
  • Signature in the presence of a notary public

Notarization Process

The document must be notarized to be legally valid. A notary public will verify the individual’s identity, witness the signing, and apply their official seal to authenticate the affidavit.

Authentication and Apostille Process

When Authentication is Needed

If the affidavit is to be used internationally, it may require authentication or an apostille to be recognized in another country.

Apostille Certification

Canada officially joined the Hague Apostille Convention on January 11, 2024, and began issuing apostilles as of January 11, 2024. An apostille is an internationally recognized certification that verifies the authenticity of a Canadian public document (such as a birth certificate, notarized affidavit, or corporate record) for use in another Hague member country. In Canada, apostilles are issued by Global Affairs Canada or an authorized provincial authority, depending on where the document was originally issued.

Legalization for Non-Hague Convention Countries

If the destination country is not part of the Hague Apostille Convention, Canadian documents must go through the traditional authentication and legalization process. This typically involves:

  1. Authentication by Global Affairs Canada or a provincial authentication office.
  2. Legalization by the embassy or consulate of the destination country.

This two-step process ensures your Canadian document is recognized as legally valid abroad in non-Hague countries like China, the UAE, Syria, Iraq, or Cuba.

Common Challenges and How to Overcome Them

Delays in Processing

Obtaining an Affidavit of Single Status can take time, especially if additional certifications are required. To avoid delays, applicants should gather all necessary documents in advance and check specific requirements for their intended purpose.

Rejection Due to Incorrect Information

Errors in personal details or failure to follow the correct notarization process can result in rejection. Double-checking information and consulting a professional can help prevent such issues.

Additional Country-Specific Requirements

Some countries may require supplementary documentation, such as divorce decrees or witness statements. It’s crucial to verify these requirements beforehand to ensure compliance.
