What Is a Cohabitation Agreement?

In Ontario, it’s recognized under the Family Law Act, which means it can be enforced in court if it’s properly executed.

Is Notarization Legally Required?

No. Under the Family Law Act, a cohabitation agreement is valid if it’s in writing, signed by both parties, and witnessed. A notary isn’t legally required to be that witness.

That said, there’s a meaningful difference between “technically valid” and “practically protected.”

Why Notarizing It Is Worth Doing Anyway

Notarizing a cohabitation agreement adds a layer of authenticity that matters when the agreement is submitted to a bank, a lawyer, a court, or an immigration authority. A notary confirms that both parties appeared, that the signatures are genuine, and that the document was signed without pressure or confusion.
