These terms and conditions (the "Terms and Conditions" or "Terms & Conditions") govern the use of www.notablenotary.ca (the "Site"). This Site is owned and operated by Notable Notary. By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

No Legal Advice or Solicitor-Client Relationship

Notable Notary provides notary public and commissioner services in and for the province of Ontario. We are not a law firm and do not provide legal advice. The content of this website is for informational purposes only. Your use of, or reliance upon, the information in this website does not, and is not intended to, establish a solicitor-client relationship. Kindly seek legal advice from a licensed lawyer if you require further assistance.

Intellectual Property
All content published and made available on our Site is the property of Notable Notary Inc. and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

• Violate the intellectual property rights of the Site owners or any third party to the Site;
• Hack into the account of another user of the Site; or
• Act in any way that could be considered fraudulent.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site or obtaining any services we may offer at any given point in time.

Accounts
When you create an account on our Site, you agree to the following:

1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
   

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Services
These Terms and Conditions govern the sale of services available on our Site.

• Notarization
• Commissioning
• Document Drafting
• Courier Delivery
• Travel Fees
• Document Authentication
• Recording of Video Conferences

The services will be paid for in full when the services are provided.

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site "as is".

We reserve the right to modify, reject or cancel services whenever it becomes necessary. If we cancel service and you have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Client Responsibilities

• Clients must provide valid, government-issued identification at the time of notarization. If a client fails to provide proper identification or if fraud is suspected, Notable Notary reserves the right to refuse service.
• Clients are responsible for ensuring that their documents are complete and accurate before notarization. Notable Notary is not responsible for errors, omissions, or rejections by third parties due to document inaccuracies.
• Clients must not attempt to notarize fraudulent or misleading documents. Any false or misleading information provided may result in service refusal and reporting to the appropriate authorities.

Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Payments
We accept the following payment methods in connection with our services:

• Credit Card;
• Visa Debit;
• PayPal;
• Debit;
• e-Transfer; and
• Cash.
  

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Refunds and Cancellations
We provide refunds for services sold on our Site as follows:

• Partial refunds (up to 50%) may be issued if Notable Notary is responsible for an error that cannot be resolved by re-notarizing the document(s).
• Cancellations: Clients may cancel their appointment at least one (1) hour in advance for a full refund. Failure to provide adequate notice will result in a $10 cancellation fee.
• No Shows & Late Attendance: Failure to attend an appointment will result in a $10 no-show fee. Clients arriving more than 10 minutes late without notice will be charged a $5 late fee.
• Rescheduling: Clients must reschedule at least one (1) hour in advance. Failure to provide adequate notice will result in a $10 rescheduling fee.

Messaging and Communication

By providing your contact information, you consent to receive:

• Promotional Messages: Offers, discounts, and limited-time deals.
• Informational Messages: Appointment confirmations, updates, and reminders.
• Marketing Content: Newsletters, service updates, and educational resources.

Messaging Frequency

You may receive messages weekly, depending on service updates and promotional campaigns.

Messaging Charges

Message and data rates may apply based on your mobile carrier.

Unsubscribe Instructions

To stop receiving messages:

• Text STOP to unsubscribe from SMS communications.
• Click the Unsubscribe link at the bottom of any email.

Non-Disparagement Clause

Clients agree not to make any false, misleading, or disparaging statements about Notable Notary, its services, employees, or affiliates in any form, including online reviews, social media, or public forums. If a client has a legitimate complaint, they agree to first contact Notable Notary to resolve the issue. Violation of this clause may result in legal action.

Compliance With Laws

Clients agree to comply with all local, provincial, and federal laws when using Notable Notary’s services. Notable Notary will not provide notarization services for documents that are illegal, fraudulent, or used for deceptive purposes. If a client attempts to use Notable Notary’s services in violation of applicable laws, we reserve the right to refuse service and report the incident to relevant authorities.

Electronic Signatures and Agreements

By using this Site, booking an appointment, or making a payment, you consent to conducting transactions electronically. This includes receiving agreements, notifications, and communications electronically. Your electronic signature or agreement to these Terms and Conditions shall be legally binding and equivalent to a physical signature.

No Guarantee of Outcome Clause

Notable Notary provides notarization services in accordance with applicable laws and best practices; however, we do not guarantee that a third party (such as a government agency, court, or business) will accept a notarized document. It is the client’s responsibility to verify the requirements of the receiving party before requesting notarization. Notable Notary shall not be liable for any losses resulting from the rejection of a notarized document.

Website and System Downtime

Notable Notary strives to keep its website and online booking system operational at all times. However, we do not guarantee uninterrupted access, and we are not responsible for any delays, interruptions, or errors caused by technical issues, server downtime, or system maintenance. If a technical issue prevents a scheduled appointment, Notable Notary will make reasonable efforts to reschedule at a mutually agreed time.

Limitation of Liability
Notable Notary and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Notable Notary and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Force Majeure 

Notable Notary shall not be held liable for delays or failure to provide services due to unforeseen circumstances, including but not limited to natural disasters, power outages, governmental actions, pandemics, or server failures.

Applicable Law
These Terms and Conditions, and any disputes or claims arising from them, shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any legal action must be filed exclusively in the courts of Ontario, Canada

Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Notable Notary are unable to resolve any dispute through informal discussion, then you and Notable Notary agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Notable Notary.

Notwithstanding any other provision in these Terms and Conditions, you and Notable Notary agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes to Terms and Conditions
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
