What a Power of Attorney Actually Does

A Power of Attorney (POA) is a legal document that gives someone you trust, your attorney, the authority to act on your behalf for financial, property, or personal care decisions. A general POA covers broad authority, while a specific or limited POA is restricted to a single transaction, such as selling a property or accessing a particular bank account. Most POAs used abroad are notarized in front of an Ontario-licensed notary, confirming your identity and that you signed it willingly and with understanding of its contents, before it's submitted for an apostille.

In Ontario, it's worth knowing these are treated as two separate documents: a Continuing Power of Attorney for Property covers financial and property decisions, while a Power of Attorney for Personal Care covers healthcare and living decisions. Many clients need both apostilled, especially if a representative abroad may need to step in for either reason, so it's worth confirming with your destination which one, or both, is required.

A couple of things ODS is strict about: they only accept hard-copy originals or notarized documents, electronic or scanned copies can't be authenticated. If your document bundle is thicker than a quarter inch, it needs two holes punched in the upper-left corner for the certificate to attach, we take care of this for you as part of preparing your order.

Confusing the two types of POA

A Continuing Power of Attorney for Property and a Power of Attorney for Personal Care cover different things. Many situations abroad call for both, not just one.

Not confirming destination acceptance first

Not every country or institution accepts a Canadian-notarized Power of Attorney. Confirm with the receiving party before you book your notary appointment.

Showing up without valid photo ID

The notary must verify your identity in person (or online) before notarizing. Without valid, current government ID, the appointment can't proceed.

Leaving the scope of authority too vague

A POA that's unclear about what powers are granted can cause delays or be rejected by the receiving institution. Be specific about what your representative needs to do.
